I represent the business listed above and approve to submit this application. I acknowledge and agree to the following terms and conditions in consideration of being allowed to participate in the event involving the food truck visit at Gobbler's Knob Swim and Tennis Club:
Assumption of Risks: I understand and acknowledge that participation in this event involves certain risks, including but not limited to, the risk of personal injury, illness, property damage, or loss.
Release of Liability: I hereby release, waive, discharge, and covenant not to sue the Gobbler's Knob Swim and Tennis Club, its directors, officers, employees, volunteers, agents, and any vendors including the food truck operator, from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any property belonging to me, whether caused by the negligence of the releases or otherwise, while participating in such activity, or while in, on, or upon the premises where the activity is being conducted.
Indemnification: I agree to indemnify and hold harmless the Gobbler's Knob Swim and Tennis Club, its directors, officers, employees, volunteers, agents, and any vendors including the food truck operator, from any loss, liability, damage, or costs, including attorney's fees, that they may incur arising out of or related to my participation in the event.
Photographic Release: I hereby grant permission to the Gobbler's Knob Swim and Tennis Club and its authorized representatives to take photographs or videos of me during the event. I authorize the use of these photographs or videos for any legal purpose, including but not limited to publicity, copyright purposes, illustration, advertising, and web content.
Acknowledgment of Understanding: I have read this waiver and release form fully and understand its contents. I am aware that by signing this document, I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily.
By submitting the form, I certify that I am at least 18 years of age and competent to enter into this agreement. If the participant is under 18 years of age, your application a parent or legal guardian must also sign below.
I agree to all the State and Local laws pertaining to my business operating within the city limits of Helena Alabama and do so without any promises of payment from Gobbler’s Knob Swim and Tennis Club for any services and/or fines rendered during my voluntary visit.
