Entertainer's Liability Waiver & Release Agreement
This Entertainer's Liability Waiver & Release Agreement ("Agreement") is entered into between (the signing person), hereinafter referred to as the "Entertainer," and Gobbler's Knob Swim & Tennis Club, hereinafter referred to as the "Club." This Agreement shall be effective as of the date of the signed contract and will remain in place throughout the entirety of the year signed.
1. Waiver of Liability:
The Entertainer hereby acknowledges and agrees that the Club shall not be held liable for any injury, loss, damage, or harm that may be suffered by the Entertainer, their guests, or their equipment while performing at Gobbler's Knob Swim & Tennis Club. The Entertainer assumes all risks and hazards associated with their performance and hereby waives any claims, demands, actions, or causes of action against the Club, its directors, officers, employees, agents, and affiliates arising from or related to their participation in the Club's events.
2. Release of Claims:
In consideration of the opportunity to perform at Gobbler's Knob Swim & Tennis Club, the Entertainer releases the Club from any and all claims, liabilities, suits, or demands of any nature whatsoever, including but not limited to claims for personal injury, property damage, or any other loss that may arise as a result of their participation in the Club's events.
3. Waiver of Financial Benefit:
The Entertainer acknowledges and agrees that any recording, picture, video, or promotional material taken during their performance at the Club's events shall become the exclusive property of Gobbler's Knob Swim & Tennis Club. The Entertainer hereby waives any right to any financial benefit, compensation, or royalties arising from the Club's use of such materials to promote its past and future events.
4. Reservation of Rights:
All rights to use, reproduce, distribute, display, and promote any recordings, pictures, videos, or promotional materials taken during the Entertainer's performance at Gobbler's Knob Swim & Tennis Club are reserved exclusively for Gobbler's Knob Swim & Tennis Club.
5. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the Alabama without regard to its conflicts of laws principles.
6. Other Rules:
This agreement also signifies that the Entertainer will abide by all rules that are set forth by the Club for any guest in attendance and any violation of the posted rules can result in an early termination of the event and reduction in pay for services rendered.
7. Entire Agreement:
This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written.
